Terms of Service
Welcome to Garma. These Terms of Service ("Terms") govern your access to and use of the Garma platform, website, and services (collectively, the "Service") operated by Garma ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Service Description
Garma is a B2B AI product photography platform designed for the fashion and garment industry. The Service transforms basic garment photographs into professional on-model product shots using artificial intelligence. The Service includes, but is not limited to, image upload, AI-powered image generation, collection management, style template selection, image review, and bulk export capabilities.
2. Account Registration
To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization. If you are using the Service on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.
3. Subscription Plans and Billing
Garma offers multiple subscription tiers, each providing a set number of generation credits per billing cycle. Plan details, pricing, and credit allocations are displayed on our pricing page and may be updated from time to time.
- Subscriptions are billed on a recurring monthly basis unless otherwise specified.
- Payment is processed through our third-party payment providers.
- You authorize us to charge your selected payment method for all fees associated with your subscription.
- If your payment method fails, we may suspend access to the Service until the outstanding balance is resolved.
4. Credits and Usage
Image generations on Garma consume credits. Each generation attempt deducts credits from your account balance, regardless of whether you approve or reject the resulting image. Credits are allocated according to your subscription plan and reset at the start of each billing cycle. Unused credits do not roll over to the next billing period.
We reserve credits at the time a generation request is submitted. If a generation fails due to a system error on our end, the reserved credits will be refunded to your balance automatically.
5. User Content
"User Content" refers to any images, photographs, text, or other materials you upload to or create through the Service.
- You retain all ownership rights to the original photographs and materials you upload.
- By uploading content, you grant us a limited, non-exclusive, worldwide license to process, store, and transform your content solely for the purpose of providing the Service.
- You represent that you have the necessary rights and permissions to upload and use all content submitted to the Service, and that such content does not infringe on any third-party intellectual property rights.
6. AI-Generated Content
Images generated by the Service using AI are created based on your input photographs and selected style templates. You are granted a perpetual, worldwide, royalty-free license to use, modify, distribute, and commercially exploit all AI-generated images created through your account for any lawful purpose.
We do not claim ownership over AI-generated content produced through your use of the Service. However, we cannot guarantee that AI-generated images will be unique or that similar outputs have not been generated for other users using similar inputs.
7. Acceptable Use
You agree not to use the Service to:
- Upload, generate, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
- Generate images that depict minors, non-consensual scenarios, or content that violates applicable laws.
- Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms.
- Interfere with, disrupt, or place an undue burden on the Service or its infrastructure.
- Use automated tools (bots, scrapers) to access the Service without our prior written consent.
- Resell, sublicense, or provide access to the Service to third parties without authorization.
8. Intellectual Property
The Service, including its design, code, AI models, templates, branding, and documentation, is owned by Garma and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without prior written consent.
9. Data Processing
Your use of the Service involves processing your uploaded images through third-party AI services. We process your data in accordance with our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you acknowledge and consent to such processing.
10. Service Availability and Modifications
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of material changes that affect your use of the Service.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Garma and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.
Our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated images will meet your specific requirements, expectations, or quality standards.
13. Indemnification
You agree to indemnify, defend, and hold harmless Garma and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
14. Termination
You may cancel your account at any time through your account settings. We may suspend or terminate your access to the Service if you violate these Terms or for any other reason at our reasonable discretion, with notice where practicable.
Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as described in our Privacy Policy. Any credits remaining in your account at the time of termination are forfeited and non-refundable, except as required by applicable law.
15. Modifications to Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service. Your continued use of the Service after such notice constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service.
16. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Garma is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
